1. Acceptance of Terms
By accessing or using BrainWise ("the Platform", "we", "us"), operated by BrainWise Ltd, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Eligibility
BrainWise is intended for students aged 11 and above studying GCSE or A-Level curricula in the United Kingdom. Users under 18 must have parental or guardian consent. By creating an account, you confirm that you meet these requirements or that a parent/guardian has consented on your behalf.
3. Account Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at support@brainwise.org if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Subscriptions and Payments
Certain features of the Platform require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis and are non-refundable except where required by UK consumer law.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We use Stripe to process payments securely — we do not store your card details.
Session booking fees and tutor payouts are governed by the session booking terms presented at checkout.
5. Acceptable Use
You agree not to:
- Share, reproduce, or distribute Platform content without permission
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Platform
- Post or transmit any harmful, offensive, or misleading content
- Impersonate another person or entity
- Use automated scripts or bots to access the Platform
6. Intellectual Property
All content on BrainWise, including questions, explanations, UI design, and branding, is owned by BrainWise Ltd or its licensors and is protected by UK and international copyright law. You are granted a limited, non-exclusive, non-transferable licence to access content solely for personal educational use.
7. Tutors and Sessions
BrainWise provides a marketplace connecting students with independent tutors. Tutors are not employees of BrainWise Ltd. We verify tutor credentials including Enhanced DBS certificates, but we do not guarantee the quality or outcome of any session.
Sessions are conducted via our built-in video platform. Any communication outside the Platform between tutors and students is at the users' own risk.
8. Limitation of Liability
To the fullest extent permitted by law, BrainWise Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
